Terms of Use

Effective date: 19 October 2026

These terms are the agreement between you and Theia for THEIA's Discord community and its drop alerts (Part A), and for the Theia app at members.theiatcg.site (Part B). Please read them. They're written in plain English, and they matter: they explain what Theia does and doesn't do, and who carries which risks.

You agree to these terms, our Privacy Policy and our Acceptable Use Policy by ticking the box when you sign in, and by using Theia. We record when you agreed and which version you agreed to (the effective date above).

If you don't agree with them, don't use Theia.

1. Who we are

Theia is a private project. It runs THEIA's Discord community and its drop alerts, and the Theia app. In these terms, "Theia", "THEIA", "we", "us" and "our" mean the Theia project and the people who run it. "You" means the person using any part of it.

To contact us about anything in these terms, email legal@theiatcg.site.

Part A: THEIA's Discord community, drop alerts and the TCG side

Part A applies to everyone in THEIA's Discord community and to anyone using its alerts or theiatcg.site. Part B applies as well if you use the Theia app. Section 1 above and sections 14 to 20 apply to both parts.

A1. The community

THEIA is a free Discord community for trading card games (TCG) in Australia: restock alerts and shelf finds posted by members. Being in the community doesn't give you access to the Theia app; the app is invitation only (section 3).

You must follow Discord's own Terms of Service and Community Guidelines, and the server's rules. We can mute, remove or ban anyone from the community, at any time, including for anything we think harms it.

A2. Drop alerts come with no guarantee

THEIA's alerts (pings) are automated and best effort. We don't guarantee:

Alerts can be late, repeated, missed or wrong because retailers change their websites or block automated checks, or because of problems with Discord, our hosting or our code. Don't rely on THEIA as your only way of finding stock. An alert is information, not advice or a recommendation to buy.

A3. What members post

Shelf finds and other posts come from members, not from us. We don't check them and we're not responsible for them. Don't post anything false, misleading or unlawful, or anyone else's personal information.

A4. Buying, selling and trading between members

If you buy, sell or trade cards (or anything else) with another member, the deal is between you and them. We're not a party to it. We don't check members, cards, condition or authenticity, and we're not responsible if a deal goes wrong. Use a payment method with buyer protection, and don't share personal or payment details in public channels.

A5. Retailers

THEIA watches retailers' public websites but isn't affiliated with any of them (section 12). Their names are used only to say where stock was seen.

Part B: the Theia app

Part B applies if you use the Theia app.

2. What Theia is

Theia is an automation tool. It fills in and submits checkouts on retailers' websites for you, using the details you save in it and the instructions you give it.

Theia is a tool, not a promise of a result. It tries to do what you ask, but it can't guarantee that any checkout works, that you get any product, or that you get it at any particular price.

Access is by invitation only. You sign in with your Discord account, and only accounts we have approved can get in.

3. Who can use Theia

You can use Theia only if:

4. No guarantee of a purchase

We don't guarantee that:

Retailers cancel orders. A retailer can cancel, refuse, limit or refund an order for its own reasons, at any time, including after it has confirmed the order or taken payment. Common reasons are stock errors, pricing errors, purchase limits, suspected automation, and suspected multiple accounts. These decisions are made by the retailer, not by us, and we can't reverse them.

A cancelled, refused or refunded order is not, by itself, a failure of Theia.

5. Your purchase is between you and the retailer

When Theia places an order for you, the purchase contract is between you and the retailer, under the retailer's own terms and conditions. We are not a party to that contract.

That means:

6. We are not a payment service

Theia is not a bank, a payment processor or a payment service, and it never receives, holds or moves your money.

When Theia checks out for you, your card details are entered into the retailer's own checkout, and the payment goes from your card to the retailer through the retailer's payment provider. We never see the money and can't refund it.

Any charge, pre-authorisation hold, refund or dispute is between you, your bank and the retailer.

7. Money you might lose

Checkouts can go wrong in ways that cost you money, for example:

You use Theia knowing these risks. Check your orders and your card statements yourself. To the extent the law allows, we are not responsible for amounts charged, held, refunded or lost through checkouts Theia runs for you.

8. Your accounts and your identity

You choose which retailer accounts, cards, addresses and details to use with Theia, and you are responsible for them.

Retailers watch for automated checkouts and for people using more than one account. A retailer may limit, suspend, cancel or ban an account, a card, an address, a phone number or an internet connection it believes is breaking its rules. If you use more than one account with a retailer, that is your choice, and what the retailer does about it is the retailer's decision.

We are not responsible if a retailer limits or bans you, cancels your orders, or takes any other action against you.

You must only use cards and accounts that are yours or that you are authorised to use.

9. Retailers' sites change, and Theia may stop working

Theia depends on retailers' websites, which change often and without warning. When they change, parts of Theia can stop working, work only partly, or behave unexpectedly. Some parts may stay broken for a while, and some may never be fixed.

We don't promise to support any particular retailer, product or feature, or to keep supporting one we support today.

10. Provided as is

Theia is provided "as is" and "as available". To the extent the law allows, we give no warranties or promises of any kind about it, including that it will be available, fast, accurate, secure, free of errors, or suitable for what you want to use it for.

There is no uptime commitment and no service level. Theia may be slow, down, or unavailable at any time, including during a drop you care about, and we may change, pause or end any part of it at any time.

11. Shared resources and fair use

Some of the things Theia uses are shared by everyone who uses it, for example the services that solve captchas and other bot checks, and the pool of proxy connections. If one person uses too much, everyone else's checkouts get worse.

So reasonable-use limits apply. We may set and change limits on things like how many tasks you run at once, how often you run them, or which drops you run them on, and we may slow down, pause or stop tasks to keep things fair. Our Acceptable Use Policy explains this in more detail.

12. Not affiliated with any retailer

Theia is not affiliated with, endorsed by, sponsored by or approved by Kmart, Big W, Woolworths, Target, Costco, Premium Bandai, Shopify, or any other retailer or platform, or any company that owns them.

Retailer names are used only to describe which websites Theia can work with. All names and trade marks belong to their owners.

13. Fees

Theia is currently free. We don't charge anything to use it.

We may start charging for Theia, or for parts of it, in the future. If we do:

Any fees, how they are paid, and the rules about refunds will be set out in this section.

14. Our liability is limited

This is the most important section. Please read it carefully.

To the extent the law allows:

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or any other law, that cannot lawfully be excluded, restricted or changed. Where the law lets us limit our liability for breaking such a right, our liability is limited (at our choice) to supplying the service again, or paying the cost of having it supplied again.

15. If you cause a problem

If you break these terms, our Acceptable Use Policy or the law, or infringe someone else's rights, while using Theia, you are responsible for the losses, costs and claims that result, including any brought against us. This doesn't apply to the extent we caused the loss ourselves.

16. Your data

Our Privacy Policy explains what we collect, why, where it is kept, and how to have it deleted.

17. Access can be removed at any time

Access to Theia is a privilege we give, not a right. We may suspend or remove your access, or anyone's, at any time and for any reason, with or without notice, including if we think you have broken these terms or our Acceptable Use Policy.

You can stop using Theia at any time. You can also ask us to delete your data (see the Privacy Policy).

If your access ends, sections A2 to A5, 4 to 10, 12, 14, 15 and 19 still apply to what happened while you used Theia.

18. Changes to these terms

We may change these terms. When we do, we will update the effective date at the top. If a change is important, we will tell you before it takes effect, by a notice in the app, a message on Discord, or both, and we will give you at least 14 days where we reasonably can. (Fee changes always get the 30 days in section 13.) Changes needed for legal or security reasons may take effect sooner.

When the effective date changes, you'll be signed out and asked to agree to the new terms the next time you sign in. You can't keep using Theia without agreeing to them. If you don't accept them, stop using Theia.

19. Governing law

These terms are governed by the laws of Western Australia. You and we agree that the courts of Western Australia (and the courts that can hear appeals from them) have jurisdiction over any dispute about these terms or Theia.

If a dispute comes up, please email us at legal@theiatcg.site first, so we can try to sort it out.
